Legal Question in Real Estate Law in India

I had given 2 Lacs + 1 Lacs Check as an Token Amount to Purchase a Flat in Pune, Maharashtra and applied for Home Loan Now Bank has given me the List of Documents required against flat(property) the same I had handed to Flat owner to provide. Now the Owner is unable or unwilling to provide the details and refusing also to return my Token Amount. We have No Legal Agreement between us I am having on a plain paper in Flat owner's handwriting that he has received 2 Lacs Check against the Flat.......Can you please help me what should I do If the owner is not ready to sell as well as refund my Token Amount.

If you consider the owner intended to cheat you, a case may be registered with local police. You may also send him a written notice demanding back the money and if required follow up by filing a civil suit in local courts.
