Legal Question in Real Estate Law in India

A cloud was raised in the W.S. (in 1976) on the ownership of the plaintiff by the defendant.The suit is 4 possession & mense profits. A ISSUE WAS MADE----wHETHER THE PLAINTIFF IS THE OWNER OF THE SUIT PROPERTY?The suit continued all through this period.NOW the plaintiff wants 2 amend the plaint in order 2 convert the suit into a suit 4 declaration, possession & mense profit just before the judjement.IS the suit now 4 declaration & possession barred barred by the law of limitations.?

The limitation issue may be examined only on the basis of pleadings of the suit. we may not be able to 'pre-judge' the pleadings.
