Legal Question in Real Estate Law in India

Do a Company Purchasing a Land nearing 4.5 Acres in Residential Zone require to have Permission under under Sec 63 or under Sec.63-A;

Further if require and not taken and applied for Post sanction who is empowered to give the Sanction collector or Ministry and any time frame.

Zoning under MRTP is inconsequential for the purposes of BT&AL;and restrictions U/s.63 and consequence U/s.84 C may be applicable even for land in residential zone.

However, if a land is notified under section 88(1)(b) BT&AL;, then restrictions U/s.63 are not applicable.
