Legal Question in Real Estate Law in India

my father had purchased a flat in goa (india) in the year 1994. My father had entered into an agreement of sale in the same year, but a sale deed has not been enetered into between my father and the builder. My father has been expired in the year 2008. My mother and myself and my brother are the only legal heirs of my fathe and are residing in the said flat since the date of purchase.

Now we want to sell off the said flat.Now do we require a sale deed, as now the builedr is also expired and the whereabouts of his legal heirs are not known. What should i do or my mother do to sell off the said flat, kindly advice.

the facts are incomplete to answer your question. It is important to know whether father entered into agreement with builder individually or with builders firm or company. When was the agreement entered into? whether or not time was made the essence of the agreement? One has to see whether or not the earlier agrment is still alive?
