Legal Question in Real Estate Law in India

there are three flats in one floor in our coop hsg society. the middle flat was sold by entering into an agreeemnt with respective areas of sale purchased by both the adjoining flat owners, and the share certificate was transfered to one of the purchasers. subsequently one of the purchaser who was not the share holder sold his flat including the merged area trough a sale deed to another buyer. .

recently the Asst. Assessor and collector has send revised calculation of property tax merging the remaining area of the middle flat with the share holder of Flat. now the shareholder of the middle flat is refusing to pay the maintenance charges stating that there is no secound flat as the asst assessor has merged the area and he is willing to surrender the share certificates.

the problem faced by the societ is to know how we can recover the maintenace charges from the middle flat owner,

what are the remedies availabe to the society to recover the maintenance charges from the member who holds the share cerficates.
