Legal Question in Real Estate Law in India

HI,

I want to give my vacant house on rent in Mumbai. I am staying out of Mumbai. My wife is fighting a divorce case and has restrained from doing so after infleuncing teh office bearers of the society.

I was given a reply that i could do so if there are no restraining court orders.( Thanks for replying, Mr Gupta)

I donot have a court order yet but the society would not give me NOC for leasing out.

In such a case, how do I go ahead for renting out my premises.

the society has no right to not to issue an NOC to you for leasing out the flat owned by you. you may approach the court and seek orders against the society.

Your wife is entitled to a "shared accommodation" under D.V.A. therefore, you should better not try to lease your premises till you settle with her.

You are advised to settle the dispute amicably.
