Legal Question in Real Estate Law in India
Mrs. S is a widow aged 87 Years living at Bharuch, Gujarat. She was living in Rented premises since 47 years approx. premises belong to charitable Trust. She has 3 daughters & 2 sons. Two daughters are married 1 younger son is married. Son is presently living in the same Premises with his wife, since more than 5 years. Rent Receipt is in the name of Mrs. ‘ S ’ . Premises is very old and structure is dilapidated. As such Mrs. S’ is living in a flat ( with Elder son & un married daughter ) own by her married daughter .
Now advice on following : 1.Wheather son who is living in rented premises since 5 years can transfer Rent receipt in his name. ?.
2.In absence of Mrs. S’ can Rent receipt legally transfer in the name of Elder son. ?.
3.What about Right of unmarried daughter . ?.
4.What about Right of the Younger son. And his wife ?.
5. Weather any right of married daughter ?
