Possesion of flat in Jaipur
I booked a flat in jaipur with a company name Uma build estate ltd on june 04with assurance of getting possesion with-in 1.5 yr. But now the builder is telling that their company consisting of two partners. one of them has forcibly taken over the keys of the flat and locked all the flats and putting some undue pressure on him to resolve some of their financial problems and not allowing the client booked the flat with him to get the registration done and getting the possesion. The project is complete but still i am denied to get the possesion on some pretext or other. I am a Air force personnel and at present posted at delhi and already spent most of my leave entitled in a yr to run after the builder. He is telling that the problem will be resolved but it may take some time, already 7 months past .I have taken homeloan from Air Force Group Insurance Society and paying the instalments for last 3yrs. I have made full payment asked by the builder. What should i do? Advice Please

Take suitable criminal action against Uma Build Estate Ltd and its Directors who looks after the affairs of the company. Also initiate action before Consumer Forum.

The internal matter of the company has nothing to do with your right to get possession of your flat as per the cotract stipulated between you and the company. All the papers and correspondence between you and the company are required to be looked into to give appropriate advise and further course of action.You may call on my mobile 9873343288 for any assistance/query.

You have a right to possess your flat. The inter se dispute b/w the partners has nothing to do with your possession. If the builder does not give you the possession within the time period he has given you he is ALSO liable to pay you damages for that along with the possession of the flat.
