Legal Question in Real Estate Law in India

Possession of flat

Thanks Mr goel and shrichand for answering my query. Have another question. My builder has done the documentation on the stamp paper where it mentions that i am satisfied with all the work done by the builder and have no objection on builders work. It also mentions that we agree that builder will have the OC and then would give the possession of the flat. Need to know if any undertaking form needs to be signed before taking the possession of the flat becuase builder has mentioned all the rules again on the undertaking form which is there in the agreement. It is not mandatory that builder sends an intimation letter for the possession of the house? Regards--name removed--

Re: Possession of flat

First inspect the flat and only then sign the same. else in future you will not be able to file any case against the builder for any cheap material.

Re: Possession of flat

Though not a mandatory requirement of law, in practice it is followed by builders in view of actions taken by flat holders subsequent to actual possession.
