Transfer laws

My parents & brother reside in a pagdi house in India whereas I relocated overseas due to my work.My parents have not made a will so after them will my brother & I have equal right on the house or will it get transferred to my brother since he is physically living in the house.

Yes children can have right in the property acquired by the father. If you given consent that you does not require any property and you wanted to give it to your brother then the property can be transfered on your brothers name.

Pagdi House? You mean to say the property is on long lease hold.

Please clarify the meaning of Pagdi House?
