Legal Question in Telecomm Law in India

sir,

one my friend holding a pvt telephone connection landline from it's opening in his town had some problem, pls clarify

my friend had telephone connection and used pay the bills till 2007 june and in june when he was left with one due an executive came to his father for payment and his father paid the balance and asked for the disconnection procedure as they are holding mobiles and other telephone instruments. but the executive told them regarding a life time scheme. so my friend father paid for the scheme in the office after three days. But the company people did not added the offer to them, and started to cut off the payment from the advance payment paid for the scheme of lifetime and they have not sent them any bills. they came to know it after the phone was disconnected. so when they visited the office they told that they have to enquire it inthe hyd office. but when ever they visit them they use to tell them that there was a server problem at the headoffice and will intimate them later. This was happend several times and as the office was so far from their home they left it.

But later the office people started sending executives to collect the deu's but when my friend and his father saying them about the problem they started to quit to ask them and after some months when new executives comes to work they use to come to them and after listening the problem they use to quit to ask. My friend went to the office several times regarding this problem and they have not given any correct information. and we don't have any written information about our visit to them.

So finally after two years they have asked them for the telephone instrument to return back them but my friend had not obeyed to them as they have not provided them the promised service. so finally they told them that they will look it clearly and provide some help. but after two days back they got a notice from the office lawer through (UCP) to return back the instrument and pay them Rs 1000 for lawyer fee.

My friend is having the bill with him. and he had faced a very bad experience with the telephone people. plz help him how to take action against them, as he had no proof for his visits to their office but only having the bill he had paid in advance for the lifetime scheme. Is there any problem if he left the lawyer notice. pls kindly help him out.

First send the reply of legal notice that you have paid the whole bill.

NExt you can approach to the consumer court.

You should reply to lawyer's notice narrating the facts you are aggreived of and ask for reasonable compensation. Then approach consumer forum.

Dear Dr. Bhaskar,

Sometimes the legal cost of fighting even for a just cause may be too high. It seems that you have genuine problem, but it is better to settle it without legal recourse and pay up and close the matter.
