Legal Question in Wills and Trusts in India

i want to get a copy of the will that may or may not have been registered. what would be costs? how long would it take? finally depending on the contents we may or may not contest the will. Thank ou Mr. V Arya. Perhaps i should have mentioned that this is in Mumbai and not Delhi. would that make a difference?

you can get a copy of the will only if you are beneficiary or the executor. Or else it is not a public document and is purely private

i agree with Adv Arya. you can get the cost of obtaining the same from registration office if will is registered.

It is not clear whether you want to know- if the Will is there? if it is registered one? if it is not registered? In such circumstances, if you are one of the beneficiaries, you can issue Notice for production of the Will, if any- registered or not, to the other beneficiaries under the Hindu Succession Act/Evidence Act as applicable to you. Then you may decide for further action. Relevant Section of Evidence Act is 63/65 onwards for Wills removed or destroyed by the other beneficiaries.
