Legal Question in Wills and Trusts in India

My family lives in Australia.We have a property in Goa.In order to sell we wish to give a POA to a friend.Can we do this from Australia with the Indian Counsul endorsement or does it have to be executed in Goa.

You can give Power to that friend but it has a draft to be drafted in such a way so that there is a set of procedure to be followed by which you can give power and it has to be adjudicated in Concerned GOA Sub Registrar Office so that everthing can be sorted out you no need to come to Goa for its execution. Also find some confidant person inorder to complete the transaction as he should not betray you.

You can execute a POA in favour of your friend by getting attested by Indian High in Australia. You dont have to do the same in Goa.

despite the fact that you may execute a POA, but it advisable to sell the property yourself by coming to india. the POA may be objected by the Registrar and may demand your personal appearance in accordance with the Indian Registration Act.
