Married sister's right in dead mother property

A plot with house thereon was transferred by municipal board in the name of my father and my two brother after the sudden death of my mother without any will. My married sister gave her affidavit for NOC that she has no inetrest in the property. Now after more than 01 yr she filed case against us and demanded her share. We are surprised. We are also living in the house. Pls advise us what to do and whether still she has right to do so once the proprty transferred in our name.

Re: Married sister's right in dead mother property

She is entitled to her share in her mother's property. The transfer of property in your name may not deprive her of her legal rights. She may not only file a civil case but may also consider filing a criminal case of cheating and domestic violence against all the three of you.

It may be better for you to settle the matter out of court and obtain a "Relinquishment Deed" or any other conveyance deed from her whereby she may transfer her share in favour of the remaining heirs.
