Legal Question in Family Law in Indiana

Change of Venue

Myself, among others, have witnessed the judge in our case smiling, waving, and actually walking up and having a conversation with the opposing party only minutes before he was to hear our case. This is not an isolated incident. He will not let me speak. I have begged for that courts help when my ex takes off with the children, he wont let me see them. he wont let me talk on the phone. I track them down through the police, and through schools. This judge will not let me speak in court. For some of the things my ex has done, most judges would have held him in contempt. Plus, my ex's father was a police officer there. This town is small and everyone knows eachother. I am not familiar with the town. the children have dissapeared again and I plan on taking him back to court and try and modify the custody agreement. My questing is, do I ask for a change of venue before...or after I petition the court to modify custody. My children an I will NEVER get a fair hearing at this court. Him personally knowing the judge is in my opinion, a conflict of interest.

Dear Madam,

Do not assume that because the judge is friendly that there is a conflict. Lawyers can wear 2 hats. But if you still feel this way, as for change of judge prior to before the petition to modify is heard.
