Legal Question in Disability Law in Indiana

Company discriminating againt disabled

I work for a multi billion dollar company. This company use to make accommodations for the disabled but now is going through several law suits because it never followed the restrictions given to the employees. Now they want to change everything. They go on a bidding system for jobs and expect us disabled to bid on jobs which are usually none we can do and before were told were not allowed to bid on because disabled. We are also to carry a card with us listing our disabilites so we can show any supervisor that we may work for. We have one year to get a bid job if within that one year can't find a job they force us on STD for 6 months if nothing comes up then we go to LTD. They are not going to help place us in a job nor are they going to accommodate any of our restrictions. We are on our own to find something we can do. A lot of people have gone in and folded and had there restrictions lifted for fear of loosing there jobs. The rest of us have restrictions that can't be lifted. Is this company allowed to do any of these things? Some of us have worked in areas for years and if they allow us to stay they want to drop our pay any were from 10 to 13 dollars on the hour. We are also being singled out in meetings for the disabled only.

Re: Company discriminating againt disabled

The Company may be violating the ADA with respect to certain individuals who are in fact disabled within the meaning of the statute. Not everyone with a restriction will be considered disabled under the statute. I would suggest that you contact an attorney to discuss your restrictions and the company's actions to ascertain whether you have a claim under the ADA. If you would like, I can be reached at [email protected] or the numbers listed in my profile.

On its face, their new "policy" seems to violate the ADA law.

You need to discuss the matter in some detail with an attorney in your area. If you're near me, email me and we can set up a meeting. Otherwise, do discuss the matter with a lawyer. Make sure the lawyer works in this area of the law.
