bankruptcy

Can you file for Bankruptcy when you're on probation? The reason I ask is because when I went to talk to a lawyer, he said ''you're not on probation or anything, are you?''.

Also, about how much should a bankruptcy cost? There are so many different rates, I just would like to know what is a fair rate on that?

Probation does not disqualify a person from filing bankruptcy. However, if part of the probation terms require repayment of damages, then that amount cannot be discharged in bankruptcy. Lawyers are unable to provide a firm estimate about costs without knowing the circumstances of your case. The new bankruptcy code requires very much more paperwork, has many more restrictions. So interview a lawyer and find out what he or she says. And don't forget, the filing fees paid to the clerk are now almost $300; and you have to pay credit counsellors about $50 for prebankruptcy counselling and about $50 for postbankruptcy counselling. That is in addition to any attorney fee. Good luck.

There is no prohibition from filing BK if you are on probation or even if you are incarcerated.
