Legal Question in Business Law in Indiana

cohabitat/partners in business oral agreement

I started a company with a girlfriend and was lied to as to my position as far as the inc. was filed...I am not on the paper work. This company now owns 6 homes. There are witness's whos testimony would verify to their understanding of my position in the company. I have signed contracts with other companies, yellow pages ad, T.V spot contracts that all bear my John Hancock. Was origionally on the bank account as a signer. Am I dead in the water or are there enough smoking guns to prove my involvement....She claims I was an employee. Who received no paycheck for 3 years.

I can't say if the facts contained in your question are "smoking guns" sufficient to prove your case. But it looks promising. Either you get part ownership of the company or you get three years' wages -- which might prove to be more money than six overmortgaged homes. The fact that your name does not appear on the articles of incorporation is not dispositive. So gather as much documentation as you can, particularly including data about whether this company is worth fighting about and what compensation has been paid to other "partners", and make an appointment with a real lawyer who has experience in business litigation. Good luck.
