Legal Question in Consumer Law in Indiana

Wedding Deposit Refund

I booked a reception hall for a wedding in which I presented them with a $1800 deposit for ''save the date'' purposes. I cancelled the wedding 2 years in advance and now they are refusing to give my deposit back. I have written verification that the hall has been rebooked. Is my $1800 gone or do I have a chance in small claims court of getting it back? I've read that some states consider deposits as a partial payment for the entire contact and if no services were provided then the deposit should be refunded.

Thanks ~

Re: Wedding Deposit Refund

Do you have a written contract? If it says anything about refunding the deposit, then the written contract controls this situation. If you do not have a written contract, you are about out of time to file a small claims. In small claims, the judge will have to decide how this shakes out. There are not enough facts here for me to say how it may go. There is nothing statutory in Indiana about wedding deposits.
