Bankruptcy Out of U.S.

My husband and I have been retired out of the country for two years. Can you file for bankruptcy if you are out of the country but still maintaining your U.S. address? He received a summons to appear in court due to unpaid credit card debt, but was unable to do so. If he returns to the U.S., can he be arrested?

I am not aware of any debtor's prison in the United States.

Yes you can file bankruptcy and no you won't be arrested (just for failing to answer a civil summons).
