Legal Question in Credit and Debt Law in Indiana

Bill Collection

I owe a medical bill. I contacted the people, and told them I could pay them $50 every payday. They said they wouldn't accept that, and they were going to sue to garnish my wages $250 every payday. Is there any legal way to stop that, I can't afford that much?

Re: Bill Collection

For a garnishment to be legal, the amount garnished has to be the lesser of 25% of your take home pay or 30 times the federal minimum wage. To take $250 a week, you would need to have take home pay of $1,000.00 a week.

The only way to stop a garnishment is to pay the debt or file bankruptcy.
