Legal Question in Credit and Debt Law in Indiana

Can't contact the business to pay!

It has been about two years since I moved out of an old apartment. I witheld rent due to the fact that the apartment would flood and the floor molded. Since I have no proof of this anymore, I have no choice but to pay off the account which is now in collections. I don't believe the collections agency has bought the account, but I cannot contact the apartment company. Their office is never open, all numbers have been disconnected, I sent a letter and received no response. I have recently tried to call the home phone number of the landlord/owner and he is never home and doesn't return my phone calls. I have been trying to contact these people for about four months now. Is there anything I can do to get this taken off of my credit report without paying the collections agency, since I will have to pay an extra $500 fee to them. I would really like to pay the apartment complex to get this all taken care of and off my credit report, but I don't know what else to do since I can't contact them.

Re: Can't contact the business to pay!

First, are you sure that it is on your credit bureau?

Second, if it is, this is a debt that you owe. There are procedures to follow in the situation you are in but you did not do this. Self-help never really helps one's self.

You need a court to say that you do not ow this money. You can wait for them to sue you and you can counterclaim or you can hire an attorney to help you.
