Legal Question in Credit and Debt Law in Indiana

Family member has lien on home

In 1992, my first husband and I purchased a home and his uncle lent us $3,800 and put a lien on our home - stating that it would be payable with 20% interest per year after 4 years.

My husband and I divorced a year or so later, and that loan has never come up.

Recently, I was informed by my ex (whose name is still on my house) that his uncle is going to ''foreclose'' on my home for his money - which he says is now $20k.

I do realize that he cannot just forclose on my home, but I am wondering what the chances of him collecting that amount in court would be.

I am currently taking my ex to court (have over the course of the past 13 years) for child support he owes to the tune of about 20k (ironically).

What is a judge likely to do?

Re: Family member has lien on home

The debt ought to have been dealt with in the divorce. Too late for the divorce court to do much of anything about it. Surely you have talked this over with your lawyer?
