Legal Question in Credit and Debt Law in Indiana

Homeowners association dispute

I am behind in my monthly association dues in the condo association that I live in. Payments are $130/mo. and I am very behind. The reason doesnt matter, although there really isn't a reason. I just haven't paid it.

The former president of the association has told several of the neighbors that I am way behind. When asked during a association meeting if everyone had access to the books, he replied that only the board has access, as it contains personal financial information. So why then did he take it upon himself to gossip about mine?

I am wondering if I have a civil suit against the association. I have witnesses that will testify if needed that he did tell them my person financial information. I want monitary compensation if its possible.

I thank you in advance for your assistance.

Re: Homeowners association dispute

You may have a defamation case. I would consult an attorney if I were you. However, generally truth is a defense to defamation, so if you are behind on your dues, it may not be defamation. Also, condo associations have certain statutory rights and if you fall too far behind, they could take actions against you or your condo.
