Legal Question in Credit and Debt Law in Indiana

judgement enforcement on a private student loan

I am about to be sued for a private

student loan I co-signed on, but

cannot afford to make payments on.

I was not married at the time the

loan was taken out, and since then

have gotten married. I am currently

a stay at home mom, so I have no

wages that can be garnished. The

only asset with my name on it is our

home, which is joint property, and I

am also on my husband's bank

account. In what ways can they go

about obtaining collection on this

debt once the judgement is issued?

Can they garnish my husbands

wages for a pre-marital loan?

Can they put a lien on our home?

Can they garnish from our bank

account?

Can they garnish tax refunds?

Only the non-exempt assets in your name only can be attached.
