Legal Advice about death benefits

Our son recently passed away. He was 24 years old, had little money, was not married, no estate. His mother was his beneficiary on his death benefit at work. He owed money to capital one credit card and now they are wanting to attach themselves to his estate. What should and can we do?

Probate means there is an estate. Non-probate transfers mean that it is not part of probate. The kind of death benefits you are writing about are non-probate transfers. Therefore, no estate for the credit card company to worry you about.
