Legal Question in Criminal Law in Indiana

2 misdemeners and 1 felony

late last year i was arrested for pos. of marijana and para.

it was my friend's and he said it was. we both went to jail.

now i am being charged the same as he is but with a pos. of para. 2nd offence fellony. my only other offence was when i was 17 years old. i thought this misdemener wasn't on my record after i turned 18. they have not sent me a sepenna yet but this was in the local paper. can they do this?
