Can you plead no contest for a misdemeanour in the state of Indiana?

Unfortunately the answer is no. Indiana does not have no contest or nolo contendere pleas. In Indiana you actually have to be guilty in order to accept a plea agreement. During the hearing at which you enter the plea the State of Indiana through its assigned prosecutor or your defense attorney (sometimes the court will do this too) must lay a factual basis by reading into the records what would have been proven if the case had gone to trial and you as the defendant will be asked if that is true and correct on the record. A good attorney who is known and respected in the court you will appear in can usually minimize and avoid many of the damaging facts you must admit to in a factual basis and only establish a factual basis for the elements of the offense(s) you are actually admitting.
