Legal Question in Criminal Law in Indiana

My son has been arrested on several drug charges, as well as a few misc. charges. He was fleeing from pursuit in a vehicle. Drugs were locked in the console. He ditched vehicle and was approx. 2 blocks away when apprehended. He was transported to jail. Vehicle was driven by tow truck driver with no police accompaniment, only a squad car following to the station. Our question is would this be a breech in the chain of custody of the evidence? I have researched on internet and it looks to me as this breech would apply to the drugs in the console. May I have your opinion? Also, we are looking for a pro bono lawyer to take his case. I am his only income and I have only social security-disability of $800 per month.

It is unlikely that you will be able to find an attorney who would handle this matter pro bono since as a matter of law if your son cannot afford to hire an attorney for his criminal matter, the court would always appoint him one. Depending on which county his case is in, there may either be a formal Law Office of the Public Defender or a pool of qualified attorneys the Judge will appoint from, but in both cases he will be able to have an attorney appointed if he doesn't not have the money to hire his own.
