Legal Question in DUI Law in Indiana

What damages may I collect?

At 4:00 a.m. my car was struck by a drunk driver. It was parked outside of my home and there were no injuries. However, the car is totaled and only worth $1,180. Can I collect any rewards other than the cost of my rental car from the responsible party?

Re: What damages may I collect?

You may be able to collect three times the face amount of your loss plus attorney fees. Indiana has a statute that in civil court you can assert quasi-criminal conduct by the Defendant resulted in money damages to you and get treble damages-consult an attorney asap.

Was the driver insured-you may collect from them-if not, file a claim with your company for an uninsured motorist
