Legal Question in DUI Law in Indiana

This past September I was visiting a friend at Ball State in Muncie, IN and when I was there I received a Minor Consumption of Alcohol ticket after I had been drinking. I hired an attorney after it happened, but it is now January, almost February, and my attorney says the prosecutor still has not filed my case. So, my question is do you think it will get filed at all, since it's been about 120 days since I got it?

Four months ago at Ball State University in Muncie, IN you were charged with the offense of Minor Consumption of Alcohol and were given a Summon and Promised to Appear in Court. So far nothing and you're hoping it will just go away.
