Pregnancy does not automatically result in emancipation. In Indiana even a pregnant minor under the age of 18 is still subject to parental control. If you wish to seek emancipation you can petition a court which will look at your wishes to be free from parental control and protection and whether you no longer need control and protection. It will also consider if you have sufficient money for your own support and under these circumstances for your unborn child. The court will also look into whether you understand the consequences of being free from parental control and protection and will evaluate if you have an acceptable plan for independent living. Your parents and others will most certainly participate in the process. It is advisable to have a local attorney familiar with juvenile and family law guide you through the process including whether you should even seek emancipation.
