Legal Question in Family Law in Indiana

adoption question

My son is six years old and his biological father is on the birth certificate, but paternity was never established. We never went to court to have custody divided or child support set up and we were not and never have been married.

He has not paid any type of support in over three years and last year in March contact was cut off completely by mutual choice. My fiance wants to adopt my son and we need to know if his biological father has any rights to block this since he was only on the birth certificate and never in court. What steps would we have to go through to complete this.

You need to contact an attorney for the adoption. If a year has passed you are in a good position, especially if you marry and your new spouse has a relationship with your child.

Sorth answer: he will need notice of the proceedings. As you should nto be doing an adoption without an attorney, the attorney can explain everything to you. There should be no need for father's consent.
