Legal Question in Family Law in Indiana

Bill responsibilities

I would like to know how responsible I am for bills that my husband has started to acquire behind my back.He has gotten high interest credit cards and started charging things to them.He had to file bankruptcy from his previous marriage years ago with over 15,000 dollars of credit card debt. I am totally against him doing this and have finally gotten our credit to a decent level again and do not want my credit trashed. He says he'll do what he wants whether we can afford it or not.

Re: Bill responsibilities

You can't stop him from racking up debts, but you can take some measures to try to protect yourself as much as possible.

For example, if you have any joint accounts, you can separate those.

If he is signing up for credit cards in his name alone, the creditors cannot come after you for payment.

However, if the two of you were to divorce, then the court might order you to pay part of those debts, if he can show that they were things that were marital debts (i.e. both of you benefited from them during the marriage).

In Indiana, one party can file a petition for bankruptcy without the other also filing.

Best of luck to you. Sounds like a tough situation.
