Child support changed

My child support of 850.00 ended in December last year when my youngest turned 18. Without my knowledge she moved to Indiana and she and a court worker decided I owed 3000.00 in back support and again without my knowledge had the US government office in Ohio take it out of my retirement check. I was divorced in Illinois.

In Mississippi a wage withholding order is accomplished along with the judgment of divorce. Sometimes it sits in the court files without action until the one who is supposed to receive support takes action to have it served on one who owes wages or retirement payments to the parent owing support. When the wage withholding order is served on the employer or former employer, the parent who owes child support is not summoned to court as part of the process.

In some states, child support ends at age 18. In Mississippi, the obligation generally continues to age 21 or the child is otherwise emancipated. If the child is in college when the 21st birthday occurs, the court may order the support to continue until he or she completes a baccalaureate degree. If your obligation to pay support ended at age 18, and the former spouse thereafter took action to garnish money, you have a cause of action against that person for recovery of the money.
