Legal Question in Family Law in Indiana

Child support in Indiana

I was divorced in 1991. My wife was in Illinois and I was stationed in Italy. The support payments were 750.00 for three children till the last one turned majority age which was 2001. In September of last year without my knowledge they started taking out 750.00 again. I called the child support officer in Illinois and they said they had no owed payments under my social security. My ex-wife moved to Indiana and now they are enforcing their own laws to an old decree. They said I owed 3000.00 according to thier laws and it would end in December 27,2002. They are still taking out 750.00 each month for what I have no idea.

Re: Child support in Indiana

42 USC Section 666 requires that they give you notice. Obtain a copy of the notice sent to your employer. It may address your rights in Indiana to have the payments stopped and refunded. Then consider retaining an attorney in Indiana to sue your former wife and the Department of Human Services there.
