Legal Question in Family Law in Indiana

When I was 23 I thought i was divorced, I'm 46 now an just found out I wasnt till this year. I've been married and still am. Would like to get legal divorce from this husband, but I don't know if we were even legally married if previous divorce was not final. I moved away after first divorce, I had no idea that it wasn't granted. What do I do?

The first thing would be to obtain the contents of the court's divorce file in the county where it was filed. This may provide information confirming your legal status.

If the divorce was not granted, then you will have to move forward with it. The current marriage may be deemed void from the begining due to this. The situation would require the appropriate petion be filed with the court to have it considered void. This of course raises other issues reguarding childern, property and debt.
