Legal Question in Family Law in Indiana

My fiance is the sole provider of the house hold. we are due to have a baby next month and his ex wife is wanting to raise his child support. He hasnt been able to see his daughter in over a year. We are barley able to pay for ourselves and rent and if they raise his support we wont be able to afford our rent. What can we do?

Candidly, you will need to get back to work to support yourself and your child. You became involved with him knowing that he had a child already, and financially your child will always come second in line.

If you are asking whether these facts will protect your fiance from a child support increase, the answer is no, that is determioned by the income of the parents, with a few specific credits given. You can look at the child support calculator online if you have questions. Just because she asks doesn't mean she will get it.

A contempt action can be filed to resume visitation, and should be done immediately to avoid further harm to the child.
