Guardianship

Dear Sir or Ma'am,

Hi. I am a recently retired Marine Veteran with partial disability trying to go through school at ISU and take care of my family. I am in desperate need of some information and can't afford help.

Before I retired and while deployed overseas, my mom became ill and due to other problems, I allowed the Indiana court to assign a guardian to her based on recommendations from a case worker. The court made it official assigning this person permanent guardianship and said she would be paid through medicaid.

Last year I came home to take care of my mom. I brought her home from a nursing home, and my family and I took care of her until she died two months ago.

Last week, this guardian sent me a bill saying I owe her a $6,300.00 for taking care of my mom to include saying I am months behind. I find this repulsive. My questions are:

1. can she ask me to pay for taking care of mom?

2. How long does she have to file mom's death with the court.

I sincerely hope you may be able to give me some information.

Oh, boy. First, the guardian can look to the family for having supported a parent. However, the guardian must file an accounting with the court showing what money came into the guardian's hands and where it went. Your description does not sound like such an accounting. You are unclear about the nature of your disability income. I must assume that you are what we call judgment proof - but even that is not certain because of the ownership of your home. I am guessing that you live in or around Terre Haute. I suggest that you call Indiana Legal Services on Monday. I do not have a telephone number for them but there ought to be a number in the Yellow Pages. You may also be able to locate LSOI on line.
