A recent paternity test showed my exhusband is not the father of my daughter. She is 11 but we knew this since before her birth (without the test). There are 3 other children that are his. He, at this time has visitation because of parental and alcohol/drug problems. He wants to retain parental rights on my daughter. This will prevent me from being able to have her biological father tested. She wants this to be done so that she can start to establish a relationship with him, she also does not want anything to do with my exhusband. He has 10 days to show the court examples of cases where the non-bio dad can retain those rights. I need to do the opposite. Please help.....is there cases I can use to support my case? This is a matter of protecting her from mental abuse.

Given the legal issues at hand and the possible legal research which may need to be done, I would strongly suggest you retain an attorney. It would difficult at best just to provide case citations without knowing all the facts. It may also be difficult for you to properly apply these cases without the assistance of attorney as well. The result you seek may be worth the investment you make.
