recording a minors conversation

My ex-husband and I are going through a custody battle, and he is recording conversations between our 10 yr. old daughter and himself. Is this admissable in court? I have custody.

Probably not based on the sketchy facts presented. You do have an attorney, don't you? If not, get one.

If it is being submitted to impeach your child who is testifying, it may be admissible. Otherwise, I can not see any basis for admission as evidence.
