relocation of custiodal parent and child

I have custody of my 5 year son. I want to leave the state of Indiana. I have a a motion entered for violation of parenting time. The non-custoidal parent has mentally hurt my son because he's popped in and out of his life. He gave me permission to leave the state. If I get it in writing, do I still have to go to court or should I just want to leave the state till after I go to court for the petiton?

There is a specific statute that must be followed when relocating. You should contact an attorney. If you do not already have one, I have an office in Fort Wayne and would be happy to help you. Please contact me. Otherwise, you should talk to your attorney about the new relocation statute. It has only been in effect since last July.
