Step-father Adoption

My son is 5 years old. His biological father left me when I was 8 months pregnant. He's not on the birth certificate and my son has my maiden name. He ever seen him or asked to see him. He's never paid any child support or anything like that. My husband has been there for my son since he was a little baby. We've been married for 3 years now. We want to have my husband adopt my son. Would I need the the biological father's permission to do this?

Under the circumstances you describe, you would not need to biological father's permission or even knowledge to have your current husband adopt your child.

You can provide notice of the adoption via publication if you do not know where bio dad is.
