Legal Question in Civil Litigation in Indiana

auto damage

My vehicle was struck by a golf ball from the Valle Vista Golf Course and it shattered my back window. I have the golf ball that hit the window. I rent an apartment and I want to know who is responsible for the damage. This is the second time this has happened. Just last week a golf ball came within 4 inches of hitting me in the head which would have probably killed me.

Re: auto damage

If you moved in and the golf course already existed, you may have a problem collecting. However, contact the golf course and see what they do.

I would suggest that you be very cautious when walking near the course.

Re: auto damage

It has to do with assumption of risk. Who was there first - you or the golf course?

If you rented the apartment knowing it was adjacent to the course, you assumed the risk.

Contact the golf pro, he may be willing to pay for your window. Otherwise, your comprehensive insurance will pay.
