Legal Question in Civil Litigation in Indiana

battery charges

I have an 8 year old daughter and she has a condition where she has violent fits of rage on a spiratic basis. In one of these rages she proceeded to punch and kick me in the head. Just as a reaction i smacked her. i am now being charged with battery even though it was just a smack in self defense. i need to know my rights and what i need to do because i have never been in trouble nor has anything like this happened before.

You need to hire an attorney asap. You not only have crimnal charges to deal with, but there may be a CPS Investigation. good luck
