Legal Question in Civil Litigation in Indiana

Needing title to vehicle

First of all, this is all stupidity on my part.

I have a car which was titled to an exboyfriend. We split, he signed the title and sent it to me. I have lost the title. I do have the car. I have asked him to apply for a new title and offered to pay him all expenses and for time off work if need be, he refuses. Told me to take the vehicle to the junkyard. Is there a way for me to obtain the title?

Thank you.

Re: Needing title to vehicle

Ask BMV what they want. Maybe you can file an action for declaratory or injunctive relief in your local small claims court. You would sue your ex boyfriend and ask for a judgment declaring that you are the owner of the vehicle, being sure to describe the vehicle in detail, complete with VIN or compelling him to sign the BMV papers.

Or, try asking your local members of the Indiana General Assembly for help. Or ask the Governor's office for help. Or go to a used car dealer and ask them what they do when there's a lost title. Obviously, I don't know, but I would try those things. Good luck.
