Legal Question in Civil Litigation in Indiana

My niece borrowed $4000 from me. The verbal agreement was she would repy as soon as she received the payout from her 401K. 8 months have passed and no payment. She will not respond to email or voice mail. What legal action can I take? She lost her job of 31 years because she broke a corporate policy. She is now employed, after 7 months.
