Legal Question in Civil Litigation in Indiana

payment from an employer

I live in Indiana and worked for a

a man who owns his own landscape company. I have not been paid by him for hours worked

in April. I have left messages, and now he is requesting a w-9 form and other information. Can he withhold my check until he gets that information? I don not have a document with my ss# on it, and I need the money?

The employer should have had you complete a w-9 at the time that you were hired. However, you do need to supply a ss#. If you have lost your card, get a substitute.

He should have had the W-9 when you started working but one does need to be filled out. I am a bit puzzled about your not having a SSN. Indiana does have a wage payment statute that requires you to notify him in writing of the amount owed.
