Railroad crossing repair and clean up procedures?

i was in a car accident in Oct 2001 at a newly repaired railroad crossing.the company that was contracted to do the repairs to the crossing left behind a pile of asphalt next to the crossing forceing my car to flip over in which i recieved major head trauma. i have been told that the railroad or contractor is responsible for cleanup from 30 feet of the center of the tracks before opening a crossing is this true and where can i find this info at ?is this a railroad rule held by certain railroads or this a state or federal law?thank you for any info you can provide to me with this matter and thank you for your time
