Legal Question in Civil Litigation in Indiana

repossession of property

If another woman and I had an agreement that I would care for her dog during her absense, and she failed to pay as agreed for over 90 days., can I repossess the dog? I sent her certified mail that if the balance was not paid by Dec 31st I would take ownership of the dog and take her to court. That date has long passed. Now she has paid and wants the dog back...I told her too late. She didn't keep the agreement and let the balance go into oweing me 5 months of care.

Re: repossession of property

You need to give her the dog back unless you had a written agreement signed by both of you giving you the right to ownership of the dog upon nonpayment. You risk a charge of conversion (theft) if you don't return the animal.
